Certification Terms and Conditions

1. Acceptance of Terms

By accessing or getting a certificate issued/ provided by TIQ Certification and Inspection Pvt. Ltd. [the Company or TIQ], you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Certificate Issuance Process

2.1 Application:

You may apply for a certificate by completing the designated application form provided to you by the associate/ 3rd Party consultant or through other authorized channels. The information provided must be accurate, complete, and up-to-date.

2.2 Approval:

We reserve the right to approve or deny any certificate application at our discretion. Approval is contingent upon meeting the specified criteria.

2.3 Certificate Content:

The content of the certificate, including but not limited to names, dates, and other relevant details, will be based on the information provided during the application process. It will the applicant’s responsibility to ensure the accuracy of this information.

2.4 Final Approval

The relevant application form along with mandatory documents including invoices and other regulatory approval documents of the applicant may be provided maximum upto 15 days from the date of issuance of certificate in case the applicant is unable to provide the same before. Please note that in such a case the certificate number and the entire certificate itself shall be provisional. The certificate shall be deemed to be invalid in case the entire documentation is not completed within the prescribed time period of 15 days.

In case the documentation is completed at a later stage and TIQ at its sole discretion decides to treat the certificate valid, a new certificate number may be granted for the final certificate.

3. Fees and Payment

3.1 Fees:

The fees for certificate issuance are provided upon request or available with the associate/ 3rd Party consultant or other authorized channels . These fees are subject to change, and any updates will be communicated from time to time.

3.2 Payment:

Payment for certificate issuance must be made in full before the issuance process begins.

3.3 Refunds:

Refunds are granted at the discretion of TIQ and may be subject to processing fees.

4. Certificate Delivery

4.1 Delivery Method:

Certificates will be delivered through the method selected during the application process. We are not responsible for any delays or issues arising from third-party delivery services.

4.2 Lost or Damaged Certificates:

You are responsible for the safekeeping of your certificate. In the event of loss or damage, a replacement certificate may be issued at an additional cost.

5. Privacy and Data Protection

5.1 Data Collection:

We collect and process personal information in accordance with our Privacy Policy. By using our services, you consent to the collection and use of your information as outlined in the Privacy Policy.

5.2 Confidentiality:

We will treat all information provided during the certificate issuance process as confidential, in accordance with applicable privacy laws.

6. Termination

We reserve the right to terminate or suspend any certificate issued by TIQ for any reason, including but not limited to a breach of these Terms and Conditions.

7. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of India. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in New Delhi.

8. Liability Limitation

8.1 General Limitation:

In no event shall TIQ or its officers, shareholders, directors, employees or agents be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of our certificate.

8.2 Limitation of Liability Amount:

The total liability of TIQ for any claim, including but not limited to claims for breach of contract, negligence, or other tortious actions, shall be limited to the total amount paid by the applicant for the certificate issuance that gave rise to the claim.

8.3 Refund Limitation:

In the event that a refund is granted, the maximum liability for TIQ shall not exceed the total amount collected for the specific certificate for which the refund is requested.

8.4 Assumption of Risk:

You acknowledge and agree that TIQ offers certification services with the understanding that our liability is limited as set forth in these Terms and Conditions and that you assume the risk associated with the use of our services. By using our certificate issuance services, you expressly agree to the limitations of liability outlined in this clause

9. Changes to Terms

We reserve the right to update or modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. It is your responsibility to regularly review these terms. By using our certificate issuance services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
